Canada Business Class Immigration

Skilled Workers(SW):

There are three ways to immigrate under the Skilled Worker category:

1. An arranged employment offer with a Canadian company, approved by the immigration authorities
2.For students or temporary workers legally residing in Canada for a period of at least one year
3.For specialists with at least one year of full-time work experience in a profession corresponding to the list of occupations outlined by the government of Canada.

Entreprenuers/ Businesspersons

This particular category is applicable to persons who have experience in successfully conducting a business in their home country, possess the necessary funds, and are planning to acquire an existing business in Canada or start a new one.

Main requirements for the principal applicant under this category are:

•Demonstrate business experience – this means that the principal applicant has at least 2 years of experience in owning and managing a business and has employed a minimum of five people on a full-time basis

•Have a personal net worth of $300,000 CAD ( legally obtained and free of liabilities)

•Comply with the conditions of the immigration visa (applicable to this category of business immigrants) for the first three years in Canada


This particular category is for candidates who are self-employed in such fields as art, sports and farming. This immigration category was specifically devised by the Canadian government to attract artists, professional athletes, as well as to stimulate agricultural development.

Persons interested in immigrating under this category have an opportunity to take an exploratory trip to Canada in order to research conditions and possibilities for starting a business. Such trips are encouraged by the government and provide an applicant with additional points upon the assessment of the case.


Currently, there are two types of immigration programs for investors in Canada: the federal program and the program ran by the province of Quebec.

HRSDC job-confirmation: The Application Process

There is a  different between the job offer with HRDC-confirmed to obtain work visa/work permit and the job offer with HRDC-confirmed to complete points in skilled worker immigration.

To obtain a Work Permit the applicant  need a LMO (Labor Market Opinion) from HRSDC which must be obtained by their  future employer. For the Job Offer for Arranged Employment selection factor the applicant  need an AEO (Arranged Employment  Opinion) from HRSDC which also must be obtained by the employer. However it’s known that to obtain an AEO is easier than LMO.

Hiring steps from employers works like this:

1. The Culling Process
The job application process is really a culling process, so anything you do that employers can use to “cull” you out will go against you, especially with jobs that have a large number of people applying for them.

TIME is the enemy, and the employer will use techniques to save themselves as much time as possible initially when reviewing the pile of applications received.   It’s often a three step process…
Cull applications with obvious errors and poor presentation – employers will most likely give a maximum of 30 seconds to each application at this stage.

Of the applications that are now left, cull those that don’t address essential criteria, or make it hard to determine whether they do actually have the qualifications/experience requested – will give up to one minute (and not much more) for each application to determine this.

The final round will involve a detailed reading of all aspects of the remaining applications in order to determine which of these “most suitable” applicants should be invited in for an interview.

Round One Culling
If there were 100 applications for one position, at least 50% – 70% would be a good number to get rid of… sorry – cull – in the first round, and if you give them ANY excuse, you will get culled!

Hopefully, your application has already stood out because it did NOT have those glaring boo-boos which result in applications being placed in the “Thank You But Go Away” pile.

Round Two…
Of the remaining 30-50% of applications, employers would want to eliminate at least half of them in this round.

Round Three…
The 15-25% of applications which make it this far are given very serious consideration to select WHO will come in for an interview.

In almost all cases, foreign workers must have a valid work permit to work in Canada. When hiring a foreign worker, you, the employer must generally :

Submit an HRSDC Foreign Worker Application for a labour market opinion (LMO) to the HRSDC Foreign Worker office responsible for your area. Before confirming a job offer, HRSDC considers whether :

The job offer is genuine:

The wages and working conditions are comparable to those offered to Canadians working in the occupation;
Employers conducted reasonable efforts to hire or train Canadians for the job;
The foreign worker is filling a labour shortage;
The employment of the foreign worker will directly create new job opportunities or help retain jobs for Canadians;
The foreign worker will transfer new skills and knowledge to Canadians; and
The hiring of the foreign worker will not affect a labour disputes or the employment of any Canadian worker involved in such a dispute.

Once HRSDC approves the job offer, send a copy of the HRSDC LMO confirmation letter to the foreign worker.

Inform the foreign worker to apply for a work permit from Citizenship and Immigration Canada (CIC).

Q: Are medical examinations required for the visas?

•A: Before the issuance of an immigrant visa, every applicant, regardless of age, must undergo a medical examination. The examination will be conducted by a doctor designated by the consular officer. Examination costs must be borne by the applicant, in addition to the visa fees.

Q: How many types of employment-based immigration visas are available?
•A: Immigration Canada provides a yearly minimum of 90,000 employment-based immigrant visas, divided into five preference categories. They may require HRSD aproval, and the filing of a petition.
Q: Once an application is made, is it guaranteed to receive a visa?
•A: Since no advance assurances can be given that a visa will be issued, applicants are advised not to make any final travel arrangements, not to dispose of their property, and not to give up their jobs until visas have been issued to them. An immigrant visa can be valid for six months from issuance date.

Q: What about visa ineligibility or waivers?

•A: The immigration laws of Canada, in order to protect the health, welfare, and security of the Canadians prohibits the issuance of a visa to certain applicants. Examples of applicants who must be refused visas are those who:

◦Have a communicable disease
◦Have a dangerous physical or mental disorder
◦Have committed serious criminal acts
◦Are terrorists, subversives, members of a totalitarian party, or former Nazi war criminals
◦Have used illegal means to enter Canada
◦Are ineligible for citizenship.
Some former exchange visitors must live abroad for two years. Physicians who intend to practice medicine must pass a qualifying exam before receiving immigrant visas. If the applicant isn’t eligible, the consular officer will advise the applicant of any waivers.

 Q: What documents are needed for a visa application?

•A: All applicants must submit certain personal documents such as passports, birth certificates, police certificates, and other civil documents, as well as evidence that they will not become public charges in Canada. The immigration and office officer will inform visa applicants of the documents needed as their applications are processed.
Q: What if an occupation requires HRSD Approval?

•A: A person whose occupation requires HRSD approval  must have prearranged employment in Canada.

Company Approval

The prospective employer submits both forms to the local office of the Provincial Employment Office in the area in Canada where the work will be performed. The appropriate regional office of the HRSD then notifies the employer of its approval or disapproval.

Q: What if there are more applicants for a category than there are available visas?

•A: Whenever there are more qualified applicants for a category than there are available numbers, the category will be considered oversubscribed, and immigrant visas will be issued in the chronological order in which the petitions were filed until the numerical limit for the category is reached. The filing date of a petition becomes the applicant’s priority date. Immigrant visas cannot be issued until an applicant’s priority date is reached. In certain heavily oversubscribed categories, there may be a waiting period of several years before a priority date is reached.

Q: What is a “Schedule A or Skilled worker Designation”?

•A: Employment Canada has made a schedule of occupations for which it delegates authority to Immigration Canada to approve HRDS. Schedule A, Group I, includes physical therapists and nurses. Schedule A, Group II includes aliens of exceptional ability in the sciences and arts (except performing arts) and Information Technology( computers and engineers careers).
Q: What is the Labor Market Information Pilot Program?

•A: Immigration Canada provides and establish a Labor Market Information Pilot Program that will define up to ten occupational classifications in which there are labor shortages.A HSRD will be deemed to have been issued for purposes of an employment-based immigrant petition for aliens within the listed shortage occupations.

•A: Skilled Workers, Professionals Holding Baccalaureate Degrees and Other Workers receive points in when they summit their applications.

◦Skilled workers are persons capable of performing a job requiring at least two years’ training or experience
◦Professionals with a baccalaureate degree are members of a profession with at least a university bachelor’s degree; and
◦Other workers are those persons capable of filling positions requiring less than two years’ training or experience
